Terms of Service

Chatterly Calls ("the Service," "we," "us") lets you place telephone calls in which text you type is spoken aloud in a synthesized voice, and the other party's speech is shown to you as live captions. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service cannot place emergency calls. It is assistive communication software — not a telecommunications relay service, not a telephone carrier, and not a medical, mental-health, or emergency service. Never rely on it to reach 911 or any emergency number. Use your device's native dialer or your local emergency SMS/RTT service.

1. Eligibility & your account

You must be at least 18 years old, provide accurate information, and keep your password secure. You are responsible for all activity under your account. One person or entity per account unless we agree otherwise in writing.

2. You are a real, present participant

You represent and warrant that, on every call you place with the Service: you are a real person personally present and participating in the call in real time; every message spoken on your behalf reflects your own words and your genuine, chosen responses; and you will not use the Service to impersonate another person, to misrepresent who is on the call, or to make the other party believe they are speaking with someone other than you. The synthesized voice is a communication aid for your own speech — not a substitute for you, and not an autonomous agent acting without you.

3. Acceptable use

You agree that you will not use the Service, and will not permit anyone using your account to use it, to:

We may investigate suspected violations and suspend or terminate any account immediately, without refund, for conduct we reasonably believe breaches these Terms or the law. We may report illegal activity to law enforcement and cooperate with lawful requests.

4. Call disclosure

Each call begins with an automated announcement telling the other party that the caller is a real person typing their responses, which are read aloud in a synthesized voice. You agree not to disable, alter, obscure, or circumvent this disclosure.

5. Consent & recording laws are your responsibility

Laws on call consent, notification, and recording vary widely (for example, "one-party" vs. "all-party" consent states in the U.S., and stricter rules in many other countries). You are solely responsible for knowing and complying with every law that applies to you and to the people you call, including obtaining any consent required before a call, before using captions/transcription, or before retaining any information from a call. The Service does not record calls (see our Privacy Policy), but you remain responsible for your own conduct and any notes you keep.

6. Accuracy — verify important information

Speech-to-text and text-to-speech are imperfect. Captions and spoken output may contain errors. You are responsible for verifying anything important — amounts, dates, dosages, addresses, names, confirmation numbers — before relying or acting on it. The Service must not be used as the sole channel for safety-critical communications.

7. Your content

You retain ownership of what you type. You grant us a limited licence to process it in real time solely to operate the call (convert it to speech, generate optional reply suggestions, and route the call) through our service providers. You are responsible for what you choose to say.

8. Plans, trials & billing

New accounts receive a limited number of free trial minutes. Paid subscriptions renew monthly through our payment processor (Stripe) until canceled, which you may do at any time from the billing portal; cancellation takes effect at the end of the current billing period. Minutes do not roll over. We may change prices with at least 14 days' notice.

9. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Chatterly Calls and its operator, affiliates, and service providers from and against any claims, demands, losses, liabilities, damages, penalties, fines, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) any call you place or content you transmit; (c) your violation of these Terms or of any law; or (d) your violation of any right of another person or party. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted or error-free operation, that captions or synthesized speech will be accurate, or that the Service is suitable for any particular call. We are not responsible for the acts, omissions, or content of any party you call.

11. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, even if advised of the possibility. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Suspension & termination

You may delete your account at any time. We may suspend or terminate accounts for violation of these Terms, with a refund of any unused prepaid period only where the termination was not caused by your breach or misuse.

13. Changes to these Terms

We may update these Terms; material changes will be announced by email or in the app at least 14 days before they take effect. Continued use after that constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration or small-claims resolution.
